MIP case dismissed in Michigan court
Attorney William McNeil was recently successful, once again, in obtaining a dismissal of his client’s MIP case. This was due to the fact that the police arrested multiple individuals and did not get their specific, unequivocal consent to take the PBT test. In addition, the ordinance being used by the municipality was deemed to be unconstitutional based on recent Michigan Court of Appeals case law. Every minor who took the PBT had their case dismissed.
